Ontario estates often include a vehicle owned by the deceased. Sometimes the vehicle is the only significant asset of the deceased.
Ownership of vehicles is registered with the Ministry of Transport Of Ontario (“MTO”).
When ownership of vehicle is transferred, the registration of ownership of the vehicle with MTO (usually documented with a ‘green slip’) must be changed.
Transfers without probate
Sometimes it is possible to transfer ownership and registration of a vehicle with probate.

When transferring a vehicle from an estate the following documents are required:

- Cover letter
- Sworn declaration (affidavit) of entitlement
- Death certificate
Facts required
These facts are required. They should be included in the cover letter and/or sworn declaration:
- Name of deceased
- Date of death
- Name and address of transferee (person receiving the vehicle from the estate)
- Name, address and entitlement of the applicant (the person trying to transfer title to a vehicle that is in the name of the deceased)
- The applicant’s entitlement to transfer the vehicle
- Transferee’s relationship to the applicant
- Reason for transferee’s entitlement to receive the assets of the deceased either pursuant to the will, or as next of kin under the Succession Law Reform Act
- Confirmation of no liens on vehicle
- Confirmation of no debts of the estate
